People v. Foreman - Queens gun case. The police testified that they overheard Mr. Foreman threaten a bouncer outside of a club and say he was going to get his gun and shoot him.  They then followed Foreman to a vehicle from which they recovered a handgun containing Foreman's DNA.  Jury verdict NOT GUILTY on all gun charges. Queens Supreme Court, November 17, 2017.

People v. Neagle - Brooklyn attempted murder trial.  Complainant alleged Mr. Neagle hit him in the head with a shovel, crushing his skull and nearly killing him.  After Cerbin's cross-examination of the alleged victim and multiple police officers the jury returned a verdict of NOT GUILTY on all charges.  Brooklyn Supreme Court, June 29, 2017.

People v. Exantus - Brooklyn assault trial.  Ms. Exantus was accused of assaulting a senior citizen and other charges.  After Cerbin's cross-examination of the alleged vicitm and his daughter, and hearing testimony from Ms. Exantus - she was found NOT GUILTY of all charges.  Brooklyn Criminal Court, April 7, 2017.

People v. Gillette - Brooklyn domestic violence case.  After a three day trial, including testimony from the alleged victim, my client was found NOT GUILTY of all charges.  Brooklyn Criminal Court, Valentines Day, 2017.

People v. Holland - Brooklyn gun case.  After a hearing the court granted the defendant's motion and SUPRESSED the gun recovered by the police.  Brooklyn Supreme Court, January 4, 2017.

People v. Ortiz - Brooklyn Felony DWI and felony Aggravated Unlicensed Operation trial.  Two NYC police officers testified they saw the defendant driving without a seat belt and that upon being stopped he appeared intoxicated; and that he was driving on multiple suspensions.  A breath test done almost 4 hours later showed a .05 BAC.  State expert Dr. William Closson testified that at the time of arrest the actual BAC was between .11 and .15.  Jury verdict NOT GUILTY all charges.  Brooklyn Supreme Court, May 11, 2016.

People v. Brown - Brooklyn Felony DWI trial.  Prompt jury verdict of NOT GUILTY on felony DWI after police officer testimony of the driver swerving in and out of lanes, and being incoherent.  Brooklyn Supreme Court, October 27, 2015.

People v. Johnson - Brooklyn DWI trial with an alleged .09 BAC reading six hours after arrest, and testimony by three different police officers.  After Cerbin's cross-examination of the police: jury verdict of NOT GUILTY on all criminal charges. Brooklyn Criminal Court, October 2015.

People v. Hale - Attempted Murder of a Police Officer trial in New York County.  While the jury did not accept the insanity defense, they did find the Defendant NOT GUILTY on the top count of Attempted Murder in the First Degree; thereby avoiding a life sentence.  New York County Supreme Court, April 2015.  (See NY Daily News Article) (New York Post Article)

People v. Martinez-Romero - Queens County robbery trial.  Complainant testified that my client and others assaulted him and stole his wallet.  Four police officers testified, three of them said they saw the tail end of the altercation.  The prosecution offered 3 1/2 years in prison.  Jury verdict of NOT GUILTY on all charges after only 20 minutes of deliberations.  Queens County Supreme Court, February 2015.

People v. Coffman - New York County DWI trial.  Defendant was involved in a serious motor vehicle accident on the FDR Drive and allegedly admitted having "three or four beers" to two different police officers.  Nine witnesses testified for the prosecution.  One eyewitness testified that Defendant was driving erratically and speeding, several other officers and another civilian testified that they smelled alcohol on the defendant's breath.  One of the accident victims, that shared an ambulance with the Defendant, testified to smelling alcohol on the Defendant.  Jury verdict: NOT GUILTY on all charges.  Manhattan Criminal Court, December 2014.

People v. Arjoon - Queens DWI trial.  Prompt jury verdict of NOT GUILTY on DWI and DWAI charges after Cerbin cross examined a 24 year police veteran with 450 DWI arrests.  Queens Criminal Court, July 2014.

People v. Jowise - Brooklyn assault trial.  Defendant was charged with assaulting and menacing his ex-girlfriend.  Immediate NOT GUILTY verdict on all charges after Cerbin's cross-examination of the alleged victim.  New York County Criminal Court, February 2014.

People v. Velez-Garriga - Brooklyn drug sale case.  After Cerbin presented his client to a Kings County Grand Jury all charges were DISMISSED.  Brooklyn Supreme Court, October 2013.

People v. Hernandez - Brooklyn DWI trial.  Prompt jury verdict of NOT GUILTY on all charges after Cerbin's cross-examination of the arresting officer. Brooklyn Criminal Court, September 2013.

People v. Cedeno - First Degree Assault case where the prosecution alleged Cerbin's client fractured victim's orbital with a golf club.  The DA demanded 5 years in prison.  After the indictment was dismissed on a technicality Cerbin presented an eyewitness to the grand jury who offered that Cedeno never struck the victim with a weapon. The DA could not obtain another Assault 1 indictment.  Cerbin negotiated a deal with the judge and prosecutors in which his client served 8 months on a lesser charge. People v. Rodriguez - Brooklyn gun possession case, offer of 2 years state prison.  After Cerbin presented his client to a Kings County Grand Jury all charges were DISMISSED. Brooklyn Supreme Court, April 2013.

People v. Hall - Brooklyn fatality DWI trial with expert witness testifying for the prosecution. After Cerbin aggressively cross-examined and discredited the state expert's theory about the motorist's BAC at the time of the incident, crossed the accident reconstruction detective, the sergeant at the scene, and the arresting officer; jury verdict of NOT GUILTY on all criminal charges. Cristian Garcia v. Albert Cabello, 11-cv-2274 (EDNY) - Federal civil rights trial.  NYPD Police Officer Albert Cabello savagely beat and broke a teen's nose, lied about it to the Brooklyn District Attorneys office, and falsely charged the teen with feloniously assaulting him.  After the criminal charges were dismissed against Garcia, Cabello was brought to trial for civil rights violations.  After cross-examination by Cerbin; both the jury and a Senior United States District Judge found Cabello and his partner's testimony completely incredible.  The jury promptly returned a VERDICT of $50,000 plus costs and attorneys fees against Cabello.  United States District Court, Brooklyn, September 2012.  (See Daily News Article)

Semenov v. Semenov, The Appellate Division, Second Department, affirmed Cerbin's Richmond County WIN AT TRIAL, in a case in which an ex-husband tried to take his former wife's house.  Richmond County Supreme Court, 2012.

People v. Silva - Brooklyn gun possession case, offer of two years state prison.  After Cerbin presented his client to a Kings County Grand Jury all charges were DISMISSED.  Brooklyn Supreme Court, 2011.

USA v. Bass (SDNY) - Federal narcotics trafficking case. Sentencing guideline range of 120 months prison. Sentenced to time served of 4 (four) days after the court heard argument and read Cerbin's pre-sentence memorandum. United States District Court, New York, December 2011.

USA v. Vasilyev (SDNY) - Federal day care fraud case involving millions of dollars. All charges dismissed after an iniital offer of a felony plea. United States District Court, New York, 2011.

People v. Roman - DWI (.12 BAC reading) and resisting arrest trial. Jury verdict of NOT GUILTY on all charges after Cerbin's cross-examination of the arresting officer and highway technician. Brooklyn Criminal Court, 2010.

People v. Cales - DWI checkpoint trial (.09 BAC). After Cerbin cross examined the arresting officer- who was unaware that the motorist was wearing dentures- the jury returned a verdict of NOT GUILTY on all charges. Brooklyn Criminal Court, August 2010.

People v. Folstein - Staten Island Criminal Mischief trial.  Three school teachers testified that they saw the defendant intentionally damage a vehicle.  NOT GUILTY verdict after Cerbin's cross-examination of each witness.  Richmond (Staten Island) Criminal Court, August 2010.

People v. Boalds - Queens burglary case.  After Cerbin presented his client to a Queens County Grand Jury all charges were DISMISSED.  Queens  County Supreme Court, 2010.

People v. Parkinson - Queens robbery case.  After Cerbin presented his client to a Queens County Grand Jury all charges were DISMISSED. 2009.

People v. Clarke - Manhattan assault on police officers case.  All charges DISMISSED after Cerbin presented his client to a New York County Grand Jury and showed that client was in fact the assault victim.  2009.

People v. Robinson - Brooklyn felony assault charge.  After Cerbin presented his client to a Kings County Grand Jury all charges were DISMISSED. 2008.

People v. Williams - Brooklyn sex offense trial.  After Cerbin cross-examined the alleged child victim and witnesses the jury found Williams NOT GUILTY on all charges.  2007.
