Under New York law a felony is a criminal offense punishable by one year or more in prison. Felonies are generally classified as either violent or non-violent. Many violent felonies such as Assault, Burglary, and Criminal Possession of a Weapon carry mandatory prison terms. For a complete list of New York crimes under the Penal Law click here .

Note: There are many commonly charged crimes that are not contained in the Penal Law; such as DWI (Vehicle and Traffic Law) and various crimes under the Administrative Code of the City of New York.

If you are charged with a felony in New York State your case may be presented to a grand jury. If the grand jury determines that sufficient evidence of a crime exists they can return an indictment. An indictment is a formal accusation and the prerequisite to a felony criminal trial. In New York an individual charged in court with a felony has a right to testify before any grand jury convened in the matter. This important right must be preserved in writing at the defendant’s first appearance (arraignment) before the court. As such, it is very important to have an experienced attorney involved in the case at the outset since critical decisions must be made at this early stage of a criminal prosecution.
