Under New York law a felony is a criminal
offense that is generally punishable by one year or more in state prison. Felonies are
commonly classified as either violent or non-violent. Many
violent felonies such as Rape, Robbery, Assault, Burglary, and Criminal
Possession of a Weapon carry mandatory prison terms. For a

Note: There are many commonly charged crimes that are not
contained in the Penal Law; such as DWI (Vehicle and Traffic
Law) and various crimes under the Administrative Code of the
City of New York.
If you are charged with a felony in New York State your case
may be presented to a grand jury. If the grand jury
determines that sufficient evidence exists they can
return an indictment. An indictment is a formal
accusation and the prerequisite to a felony criminal trial.
In New York an individual charged in court with a felony generally has a
right to testify before any grand jury convened in the matter.
This right must be preserved in writing at the
defendants first appearance (arraignment) before the court.
As such, it is important to have an experienced criminal attorney
