Under New York law a misdemeanor is a criminal
offense; most misdemeanors are punishable by up to one year in jail. In New York
City misdemeanor cases are generally handled in the criminal court
located in the county in which the crime occurred. Some of the most common misdemeanor offenses include assault in the third degree, aggravated harassment, menacing, driving while intoxicated, criminal possession of marihuana, criminal possession of a controlled substance in the seventh degree, petit larceny, aggravated unlicensed operation of a motor vehicle, criminal mischief, endangering the welfare of a child, prostitution, criminal contempt in the second degree, and trespassing.
